Welcome to SideEye! Please read these Terms of Service ("Terms") carefully before using our application. By accessing or using SideEye, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Eligibility

To use SideEye, you must be at least 13 years old or the minimum legal age in your jurisdiction. By using the App, you represent and warrant that you meet these eligibility requirements.

2. Account Creation and Management

Account Registration: To create an account, you must provide a valid email address and any other required information.

Data Access: You may request access to your personal data at any time. We will provide this data in a readable format within a reasonable timeframe.

Account Deletion: You can delete your account at any time through the App settings. Upon deletion, all associated data will be permanently removed from our systems, except as required by law or for legitimate business purposes.

Username Restrictions: Usernames must not contain profanity, hate speech, or any content that violates these Terms. SideEye reserves the right to remove or change usernames that violate these rules.

2.1 Username and Identity Policy

Username Ownership: Usernames on SideEye are provided on a first-come, first-served basis. A username does not constitute ownership of any intellectual property, brand, or personal identity. SideEye retains the right to reassign or remove usernames at its sole discretion.

Impersonation and Misleading Use: You may not create or use a username that:

Intentionally impersonates another person, brand, or organization.
Misleads others about your identity, affiliation, or endorsement.
Violates trademarks, copyrights, or publicity rights.

If your username matches or resembles that of a public figure or brand, you must clearly indicate that your account is unofficial or unaffiliated (e.g., “fan account,” “parody,” or “unofficial”).

Trademark and Identity Claims: Owners of registered trademarks, public figures, and organizations may request control of a username that matches their name or mark by submitting proof of identity and relevant documentation. SideEye will evaluate claims in good faith and may transfer, suspend, or remove accounts that violate this policy.

Enforcement: SideEye reserves the right to:

Suspend, rename, or delete accounts that violate this policy.
Prevent reuse of usernames involved in verified impersonation or trademark disputes.
Require verification before granting access to certain usernames.

Reporting Impersonation: If you believe someone is using your name, brand, or likeness without authorization, you can report it through our in-app support system or email legal@sideeye.dk.

2.2 Content Authenticity and AI Policy

To maintain authenticity across SideEye, users must not upload or share AI-generated or heavily manipulated content intended to mislead others. AI-enhanced or filtered content is allowed only if it does not impersonate another person or misrepresent real events. SideEye may label AI-generated content or remove it if it violates this policy.

Users agree not to train AI systems on SideEye content without written permission.

3. Content Sharing and Ownership

Permitted Content: You may share photos, videos, and other content on SideEye, provided it complies with these Terms. The following content is strictly prohibited:

Illegal or unlawful material.
Pornographic, sexually explicit, or adult content.
Content that infringes on intellectual property rights.
Content that promotes violence, hate speech, or discrimination.

Ownership: You retain ownership of the content you share on SideEye. However, by posting content on another user’s wall, you grant the wall owner ("Receiving End") a license to use, display, and share that content within the App.

Moderation: SideEye reserves the right to review, moderate, or remove any content that violates these Terms. We may also use anonymized or aggregated user content for marketing or analytics purposes, with your consent where required.

Tagging: You may tag other users in comments or posts. Tagging should not be used to harass, spam, or otherwise misuse the feature.

4. Privacy and Data

Data Collection: SideEye collects the following types of data:

Profile information (e.g., username, email address).
Posts, comments, and other user-generated content.
Follower and following lists.
Usage data, including interactions with the App.

Third-Party Services: We use Firebase for data storage and analytics. Your data will not be shared with third parties except as necessary to provide the Services or as required by law.

Compliance: SideEye complies with GDPR, CCPA, and other applicable privacy laws. See our Privacy Policy for details.

5. User Interactions

Social Features: SideEye allows users to comment, like, share posts, and send direct messages (DMs). These features are intended to foster positive interactions and should not be used for harassment, spamming, or other abusive behavior.

Reporting and Blocking:

You can report abusive behavior, harassment, or spam through the App.
SideEye will review reports and may issue warnings, temporary suspensions, or permanent bans.
You may block other users to restrict their ability to interact with you.

5.1 Profile Collaboration and Approval

SideEye allows others to post photos, videos, and stories to your profile. You maintain control over who can contribute and must approve or decline submissions before they appear publicly. Contributors grant you the right to display their approved content on your profile. Misuse of this feature for harassment or spam is prohibited.

6. Liability and Indemnification

Limitation of Liability:

SideEye is not responsible for data breaches, service interruptions, or the actions of other users.
The App is provided "as is" without warranties of any kind, either express or implied.

Indemnification: You agree to indemnify and hold SideEye harmless from any claims, damages, or losses arising from your use of the App or violation of these Terms.

7. Advertisements

SideEye may display advertisements within the App. The frequency and type of ads may vary. Some advertisements may be tailored based on your activity within the App.

7.1 Influencer and Brand Collaboration

Verified creators, influencers, and brands may collaborate through sponsored posts or partnerships. Such collaborations must comply with applicable advertising and disclosure laws. All sponsored content must include clear disclosure (e.g., “#ad” or “Paid Partnership”). SideEye may remove undisclosed promotions.

8. Changes to Terms

SideEye may modify these Terms at any time. We will notify users of significant changes via email or through the App. Your continued use of SideEye after changes means you accept the updated Terms.

9. Termination

SideEye may suspend or terminate your account if you violate these Terms. Upon termination, you will lose access to your account and data. You may request account deletion at any time.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Denmark (or your applicable jurisdiction). Any disputes will be resolved through binding arbitration or a court of competent jurisdiction.
